1. Introduction

These terms govern the use of PlanAtom.com, which provides access to UK planning application data. By using the website, users agree to these terms.

2. User Registration and Approval

Users may register their interest in accessing data but must await approval from the PlanAtom team.

3. Subscription Packages and Payment

Services are available via monthly or annual subscriptions. Annual subscriptions offer a discount. Monthly subscribers can cancel anytime, with the subscription ending at the following month’s end. Annual subscribers must give 28 days’ notice before renewal, or the subscription auto-renews. Failure to process payment results in immediate access termination. Users must start a new subscription in such cases. We reserve the right to revoke access at any time, issuing prorated refunds for any prepaid period.

4. Service Availability and Local Authority Data

Not all UK local authorities are covered. Customers may request additional local authorities, potentially incurring a setup fee. This fee does not grant exclusive access to that local authority’s data.

5. Intellectual Property Rights (IPR)

All design and code of PlanAtom.com are owned by Project XI Limited. The enriched UK planning application data is our unique dataset, sourced from public domains and proprietary technology.

6. Data Accuracy and No Warranty

The data is provided without warranty. We do not guarantee its accuracy.

7. Non-Exclusivity of Data

Customers have no claim to data exclusivity. We reserve the right to sell access to any data to any party.

8. Data Use and Replication

Customers may not replicate PlanAtom data except for short-term caching (less than 60 minutes). Reselling or providing third-party access to PlanAtom data is prohibited. Customers indemnify us against any data loss or leakage, considered a material breach.

9. Limitation of Liability and Dispute Resolution

PlanAtom and Project XI Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Any disputes arising out of or related to these Terms and Conditions or the use of PlanAtom.com will be handled in the first instance through informal negotiation between you and Project XI Limited. If the matter is not resolved by negotiation, you agree to submit to the exclusive jurisdiction of the courts of the United Kingdom.

10. Modification of Terms

We reserve the right to modify these terms, with users notified of significant changes.

11. Governing Law and Jurisdiction

These terms are governed by UK law. The jurisdiction for disputes will be the United Kingdom.

We do not guarantee uninterrupted service or uptime. PlanAtom is not liable for any loss or damage resulting from downtime or unavailability of the website and its services.

15. Use of Additional Services (API, CRM Integrations, Google Sheets Extension)

The use of PlanAtom’s API, any CRM integrations, and the Google Sheets extension are subject to separate terms and conditions. Users must agree to these specific terms before accessing or using these services.
